These Terms of Use (“Agreement”) govern your use of mobile, web, and AR-based applications published under the ABCTalkWithMe brand (including ABC TalkWithMe, ABC GO, and others), created and owned by Maksym Ronshyn (“Author”).

This Agreement also applies to any associated physical or digital products including but not limited to:

  • Printed or downloadable flashcards,

     

  • PDF activity books,

     

  • Augmented reality (AR) markers,

     

  • QR codes, animations, sounds, 3D models.

     

By accessing or using these Products, you confirm that you have read, understood, and agreed to be bound by this Agreement.

1. Scope of Use

For End Users:

  • The Applications and accompanying materials are for personal, non-commercial use only and must only be used together with officially distributed educational content.

     

For Partners:

  • Partners may offer access to the Applications only as part of a physical or digital product bundle, subject to these Terms, and only with prior authorization.

     

  • You may not resell, sublicense, or modify the Applications or distribute them independently in any digital store or marketing platform.

     

2. Intellectual Property

All components — including but not limited to graphics, audio, code, text, animations, and AR assets — are the exclusive intellectual property of the Author.

  • No right is granted to reverse engineer, modify, replicate, distribute, or reuse content for training AI or other technologies.

     

  • Digital files (e.g., PDFs, AR markers) are licensed, not sold. Redistribution, resale, or duplication is strictly prohibited.

     

3. Important Notice for Parents and Guardians

The Applications are designed for young children (typically ages 3–7). However:

All use of the Applications and related materials must be actively supervised by a responsible adult.

By using these Products, you agree that:

  • Only adults may install or activate the Applications.

     

  • Children must only use the device or content under adult supervision.

     

  • It is the responsibility of the parent or guardian to:

     

    • Provide a safe, child-appropriate physical environment,

       

    • Control device usage and screen time,

       

    • Ensure the child does not interact with digital devices in a hazardous or unsupervised manner,

       

    • Prevent use of the application in inappropriate settings (e.g., while walking, near traffic, in low-light conditions).

       

The Author does not provide any guarantee of educational outcomes or developmental progress, and use of the Products should not substitute professional instruction or parental interaction.

4. Limitation of Liability

The Products are provided “AS IS” and “AS AVAILABLE” with no warranty, express or implied.

To the maximum extent permitted by law:

The Author shall not be liable for any damages, losses, or injuries, including but not limited to:

  • Physical injury to a child or adult during or after gameplay,

     

  • Device damage or malfunction,

     

  • Printing errors or AR recognition issues,

     

  • Inappropriate or unauthorized use,

     

  • Emotional, educational, or psychological effects,

     

  • Legal non-compliance in the user’s country,

     

  • Issues caused by third-party devices, software, or internet access.

     

Users and partners agree to hold harmless and indemnify the Author from any claims, disputes, or liabilities arising from the use of these Applications or materials.

5. Privacy

6. Updates and Availability

  • The Author reserves the right to modify, suspend, or discontinue the Applications or any related materials at any time without notice.

     

  • Certain features may rely on external services (such as camera, internet, or AR tracking) and may become unavailable depending on device compatibility or third-party changes.

     

7. Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
